Abstract EN

By the constitutional founder's declaration of the establishment of the administrative courts of appeal in 2020, followed by the issuance of the laws that embody this profound judicial reform in 2020, the building the administrative justice edifice announced in the constitutional amendment in 1996 has been completed.

with such reform, the judicial administrative pyramid includes the council of state, administrative courts of appeal and administrative courts which embody the principal of two degrees litigation which is legally ensured for litigants.

this reform has rehabilitated the original role of the council of state as high justice which is to consider the appeals in cassation.

in addition, it has led to reducing the problem of non appealable decisions of the council of state, bringing the administrative justice closer to litigants and improving its performance in a manner that serves the state of law.

this study aims at highlighting the foundations for the creation of administrative courts of appeal by dealing with their constitutional legislative and organizational basis.

in addition, it deals with the number of these courts, the legal effects of their creation and finally the evaluation of the judicial reform that instituted this type of course.
