The theory of abuse in the use of the right is considered as a theory which has been recently rooted.

there are several issues that belongs to it as well.

among them.

there is the neighborhood right which provides the individual which provides the individual with a safe and peaceful atmosphere within his or her property.

however.

this individual is prohibited by the force of law and legislations to use the rights arbitrarily or harm the neighbors’ Algerian legislator forbid the use of rights in harming the neighbors according to article 691 of the Algerian civil law.

arbitrariness measures are also mentioned in the repeated article 124 from the same law.

using the neighborhood rights arbitrarily leads to penalty or compensation whish can be partial or full.

the compensation can also be by agreement.

by judge’s verdict or by a legal text.
