The Algerian legislator, through Order No.

15/02 amending and supplementing Code of Criminal Procedure, has dedicated new mechanisms that aspire to expedite procedures and consensual termination of the case, including both the immediate.

They are systems that aspire to shorten and simplify procedures without being bound by the familiar and traditional court procedures.

The two procedures have proven theirpractical effectiveness in shortening the time for adjudication of cases, but it does not.

negate that these alternative procedures to the public lawsuit affect the guarantees established by the legislator for the accused and affect the guarantees of a fair trial.

It is the primacy and the principle of the right of defense.
