Article 1 of the Rome Statute stipulates that the international criminal arbitration will be complementary to the national criminal judicial systems, which theoretically means that the rule established under this system will not be an alternative or competition to the national judicial systems, but rather will be complementary to them.

However, the many subsequent texts distributed within the system clearly disclosed the nature of the complementary relationship, far from its apparent and reassuring meaning, and established the privilege and superiority of the Rome system and established its court as a supreme judicial authority that supervises and controls national criminal judicial systems.
