يلتزم الموظف العام بمجموعة من المبادئ الأساسية و القانونية التي استخلصها الفقه و القضاء الإداريين من نظرية الرفق العام٬ و التي تهدف هذه الأخيرة إلى إشباع حاجيات الجمهور٬ كما أن كل انقطاع أو تعطل في سير عمل المرافق العامة يؤدي إلى اضطراب داخل المجتمع٬ لهذا اجمع فقهاء القانون الإداري على أن ابرز القواعد التي تحكم سير المرافق العامة هو مبدأ الاستمرارية٬ لهذا اقر القضاء الإداري بدوره هذا المبدأ و أعطاه تطبيقات متعددة٬ و لعل التطبيق الأساسي لهذه القاعدة مرتبطا بمسالة شرعية تتمثل في إضراب موظفي المرافق العامة٬ و هو الأمر الذي يشكل اخطر ما يمكن أن يهدد بسير عمل المرافق العامة بانتظام و باضطراد وبدون انقطاع
Abstract EN
The public servant adheres to a set of basic and legal principles derived from the general facility theory, which aim to satisfy the needs of the public, and any disruption or disruption of the functioning of public facilities leads to disruption within society, the administrative judiciary, in turn, has recognized this principle and given it multiple applications.
The basic application of this rule may be linked to the legitimate issue of a strike by utility personnel, which is the most serious threat to the regular, steady and uninterrupted functioning of public facilities.
