The successive development of artificial intelligence multiplies its capabilities and generalizes its uses in many fields because of its developed capabilities and the ability to act independently without the need for humans, which makes it difficult to control its actions, which makes it a source of public risks and its impact on the legal system, especially with regard to determining who is responsible in cases that cause Where these modern systems harm others and in light of that, we focused through this research paper on the search for the suitability of traditional theories of civil liability stipulated in the Algerian Civil Code for application and realization of the damages caused by artificial intelligence represented mainly in contractual and tort liability, trying to highlight the most important characteristics and difficulties that hinder the implementation of these regulations
