Since adopting judicial duality under the 1996 Constitution, Algeria has adopted a special administrative judicial system, characterized by the absence of an appellate administrative judicial body, so that the administrative judiciary bodies were limited to the State Council at the top of the pyramid, and administrative courts at the base, and the State Council was entrusted with judicial competencies that transformed it from a court of law whose task is to unify administrative jurisprudence, to a multi-functional judicial body and judicial powers, which greatly affected the principle of litigation at two levels in the administrative article, but the constitutional amendment of 2020 introduced Many substantive and procedural rulings, which are considered a radical shift in the history of judicial duality in Algeria, and an unprecedented activation of the principle of two-tier litigation in the administrative article.
