Abstract EN

The Constitutional Court, created by the Constitutional Amendment of Algeria 2020, relies on the place of the Constitutional Council as the highest constitutional body entrusted with the protection of the Constitution, as well as the protection of fundamental rights and freedoms enshrined in it against any violation or derogation from the legal framework established by it.

Conformity control is the most important of these oversight mechanisms, given that they must be implemented in accordance with the organic laws, the rules of procedure of the Parliament and legislative orders issued by the President of the Republic prior to their promulgation, are aimed at protecting the principle of the primacy of the Constitution.

In this regard, the control of conformity has a direct impact on fundamental rights and freedoms, if the organization of which is referred to in organic laws, which are characterized as an extension of the Constitution and an expression of its spirit.
