تعد المكالمات الهاتفية و الأحاديث الخاصة أو السرية من عناصر الحياة الخاصة للأفراد، و تتمتع بحماية قانونية مثلها مثل باقي الحقوق المقررة للأفراد، وأي انتهاك لحرمتها يعد جريمة، و يعاقب فاعلها بالجزاء المنصوص في المادة 303 مكرر الفقرة الأولى من قانون العقوبات، و تشتغل هذه المقالة على بيان عناصر الجريمة و الجزاء المقرر لها، و من ثم بيان مدى الحماية التي يوفرها المشرع الجزائري لخصوصية المكالمات و الأحاديث
Abstract EN
phone calls and private or confidential conversations are private elements of individuals lives.
They are legally protected just like the other rights granted to individuals, and any violation of their privacy is considered as an offense and the penalty is mentioned in article 303 bis, paragraph 1, of the Penal Code.
This paper attempts to determine the elements of the crime as well as their punishment, and to show how much the algerian legislator protects the privacy of conversations and calls.
