Foster care depends in all its provisions on the criterion of the interest of the child.

there is no doubt that the religious interest of the child is one of the first priorities in assigning custody.

therefore, this research came to shed light on the position of the Algerian family law regarding the difference in religion in custody.

he concluded that the family law gave special attention to the child's religious interest, as it adopted the principle of raising a child on the religion of his father, while not neglecting the primacy of the mother's right to custody of her son even if she was an infidel-although it was not explicitly stipulated-in order to preserve the child's belief from perversion and slippage.
