The concept of "core crimes" within the jurisdiction of the ICC-as the most serious international crimes-has been crystallizing in legal literature and international law.

however, other serious crimes were excluded from the court's jurisdiction, particularly among treaty crimes.

the establishment of the ICC has passed through negotiations that led to the adoption of its statute, which is based on the criterion of gravity as a key factor in determining the crimes and when dealing with situations and cases before the court.

in this context, as a general rule, the ICC is not based on universal jurisdiction, but on the state’s consent.
