Abstract EN

This research aims to study and to assess the effectiveness of the dual method of combating drug crimes in the same legislation, which is adopted by the Algerian legislator, namely, the method of curative prevention and the method of deterrence and punishment.

the main addressed problematic of this research can hence be expressed as follows: does the dual considered method effective in developing and implementing a strategy that is able to combat drug trafficking and consumption? since the Algerian legislator makes use of the method of punishment and the method of curative prevention, we have tried in this research to understand these two methods from the theoretical point of view (legislation) and from the practical side.

we have also investigated possible limitations and shortcomings of the approach.

obtained results show that the Algerian legislator, by adopting this dual method, has not been able to solve problems associated with this phenomenon, whether those related to addicts and consumers, or those related to smugglers and illegal traders.

this has been made clear through statistics that support our conclusion.

according to interviews we have conducted with several people concerned with the phenomenon of drugs (addicts, families of addicts, judicial police, judges, agents of re-education institutions and some specialized doctors), the main reason behind this failure is the lack of proper application of legal texts, especially those related to the rehabilitation of criminals and to the curative prophylaxis protocols.

this research paper is concluded with a set of propositions that we believe can contribute to finding realistic and effective solutions.
