ما من شك في أن مسألة حل المنازعات بشكل عام على المستوى الوطني يتولاها القضاء الرسمي للدول، و بجانبه نجد الوسائل البديلة لحل المنازعات كالتحكيم و الوساطة والصلح، لكن على المستوى الدولي نجد بأن العكس هو القائم، حيث غياب القضاء الدولي المتخصص في حل المنازعات التجارية الدولية، و ريادة التحكيم و المصالحة الدولية في حل العديد من المنازعات، من هذا المنطلق تأتي هذه القراءة كمحاولة لتسليط الضوء على التنظيم الدولي لبدائل القضاء بين التشريع المغربي و بعض مقتضيات الاتفاقيات الدولية في هذا المجال.
Abstract EN
There is no doubt that the issue of the resolution of disputes in general at the national level is processed by the official judicial authorities of states, for its part, we find alternative means of resolving disputes such as arbitration, mediation and reconciliation, but at the international level we find the opposite, with the absence of specialised international justice in international commercial disputes, and the leadership of arbitration and international reconciliation in revolving many disputes, this reading comes as an attempt to highlight international organization of alternatives to justice between Moroccan legislation, and some of the requirements of international conventions in this area.

Il ne fait aucun doute que la question de la résolution des litiges en général, au niveau national, est traitée par les tribunaux officiels des états, pour sa part, nous trouvons d’autres moyens de régler les litiges comme l’arbitrage, la médiation et la réconciliation, mais au niveau international, on constate l’absence d’un système judiciaire international spécialisé dans les litiges commerciaux internationaux et la prédominance de l’arbitrage et de la réconciliation internationale dans le règlement de nombreux litiges; cette lecture est une tentative de mettre en évidence l’organisation internationale des alternatives à la justice, entre la législation marocaine et certaines exigences des conventions internationales dans ce domaine.
