Abstract EN

In the western region of the Islamic world, notary was framed by the Maliki jurisprudence and had undergone to the Islamic laws since the occurrence of Islam in the region, the same happened for justice and other issues.

however, during the modern time it went through two major phases, especially in Morocco and Algeria.

first, the French colonialism phase in the beginning of 19th century in Algeria and beginning of 20th century in Morocco.

during that time, the colonial authorities had adopted a dual method in dealing or issuing contracts and lawful documents in both states in order to differentiate between native citizens and French settlers and also to achieve colonialism set goals.

second, the post independence phase which was marked by issuing several laws and decrees as well as organizational an technical procedures to legalize and promote the notary profession.
