Customary marriage has spread in Algerian society in an unprecedented way, until the judicial arena has become teeming with many cases whose subject is proof of customary marriage, this marriage, which is in fact a legal marriage that meets the conditions of its contract and its validity.

the notary and the civil status officer has become used a lot to manipulate women and evade the responsibility imposed by the law on the husband.

therefore, the Algerian legislator must intervene to put in place a set of controls that guarantee the protection of the family in general and women in particular by criminalizing resorting to customary marriage.
