Marriage is contracted with the consent of both parties, and if there is a defect in it, it is voidable or suspended according to the civil law, but the marriage contract is subject to the family law, which arranged the penalty for nullity due to the lack of consent and did not address the issue of the effect of the defects of consent except with regard to coercion and fraud, leaving it to Islamic jurisprudence, and due to their different opinions, the penalty ranged between invalidity, corruption or unnecessaryness of the marriage, which affects the existence of the appropriate judicial solution if the judge ruled according to the principles of Islamic Sharia.
