The exceptional nature of the complaint procedure, as a restriction on the freedom of the Public Prosecution to initiate and initiate public action, in the Algerian and Egyptian legislation, resulted in them showing a legislative approach that ensures that the interest of the members of society prevail over the interest of the Public Prosecution, as it is the best interest to protect according to procedural and objective legal provisions that achieve this.

This study is concerned with clarifying the nature of the complaint, its legal nature and the characteristics that characterize the crimes of the complaint, as well as the effects of presenting it in the two legislations under comparison.
