With the emergence of covid 19, most of companies in Morocco had decided to proceed an extremely useful technique to deal with the virus and to increase their investments.
This method called Teleworking or Remote Work, it helps professionals to achieve all of the work assignments, and all of their projects outside of a traditional office environment.
However, here in Morocco, remote work is not regulated and this situation of legal gaps affect not only the contractual relationship between the employer and the teleworker but also the obligations of the employee.
Based on this, our paper consists to detect and to study all of this legal gaps throughout legislation, Jurisprudence and doctrine.

Vu l’apparition de la conjoncture épidémiologique « COVID-19 », la plupart des entreprises au Maroc avaient décidé d’opter pour le travail à distance comme un moyen de la continuation de leurs activités.
Néanmoins, le télétravail reste non-réglementé ni par la loi ni par la jurisprudence, ce vide juridique a impacté non seulement le lien contractuel entre l’employeur et le télétravailleur, mais également sur les obligations qu’incombent aux salariés.
Sur ce, notre étude réside dans le fait de cerner les lacunes juridiques qui découlent en la matière, tout on se basant sur notre homologue législation française, ainsi que la doctrine marocaine que sur la jurisprudence française.
