Abstract EN

The research aims to study the most important articles of Law No.

14 of the year 2013 and amended in 2018 on the Small and Medium Enterprises Support Fund in the State of Kuwait.

The research contained an introduction, three thematic areas and a conclusion.

The introduction covered the importance of the research, its problem, aims, previous studies, research methodology and plan.

While the first thematic area focuses on the ruler and his definition and small enterprises in Islamic Law (Sharia) and Kuwaiti law.

The second thematic area covers the ruler’s tasks related to economic affairs and support for small enterprises in Islamic Law' (Sharia) and Kuwaiti law.

Then the third thematic area discusses the main topic of the study, which is the administrative fee imposed on the loan to finance small and medium enterprises, and its Islamic jurisprudential adaptation, and discussing opinions and fat was (Islamic Law opinion) related to that topic.

The research concluded with many findings and recommendations, and the overall finding of the research was that economic tasks of the ruler in Kuwaiti law' are compatible with the general idea on which the Islamic economic system is based in terms of controlling and organizing economic relations between members of society, determining the responsibilities of individuals towards others in order to prevent conflict and disputes, regulating the relationship of individuals with productive resources, and providing appropriate solutions and means to confront the economic problems facing society.

The researchers recommended the authority in charge of the National Fund for Small and Medium Enterprises Support to reconsider and treat the administrative fee in accordance with Islamic Law (Sharia).

The researchers developed three proposals for this treatment.
