Abstract EN

In 2008, the global financial crisis produced negative repercussions on the global economy.

That financial crisis has increased risk of bankruptcy among companies due to the decrease in demand for products and services, the diminishing capacity for external financing, the decline in investments, and the decrease in remittances.

However, Covid-19 is not less dangerous than the global financial crisis, where this pandemic paralyzed the pillars of the national economy for nearly four months now.

This situation has not happened in the global financial crises in 2008.

Undoubtedly, Covid-19 will lead many companies or merchants to stop or falter paying their debts due to their negative effects.

This study highlights a cessation of paying their debts and linking it with Covid-19, while considering the extent to which companies or merchants have a cessation of paying its debts due to an accident or a disturbance to their financial position which leads them to bankruptcy.

This study also shed light on the mechanisms of rescuing companies or merchants that have a cessation of paying its debts and make their business viable.

The first section demonstrates preventive settlement and restructuring as one of the means that could be adopted by the Kuwait National Assembly to spare companies or merchants from bankruptcy.

The second section addresses practical solutions that make the company's business viable through new financing, capitalizing debts, repaying debt with the principal, (fair selling), and debt insurance.

Finally, this study presents its main outcomes and recommenda tions.
