Abstract EN

The Covid-19 Pandemic presented many several issues in different aspects of law, in particular, the criminal law as actions of some individuals not following the precautionary measures.

These behaviours led to spreading the virus significantly.

As a result, there was an amendment of the Kuwaiti criminal law.

Specifically, criminalising the deliberate transmission of diseases.

Unfortu nately, this amendment does not reflect the complexity of the crime, in particular, the issues of the knowledge of the crime and the causal relationship between the action and the result, as these issues considered essential factors in this crime.

Also, the lack of the Kuwaiti and Arabic judicial decisions in this matter deepens the issue further.

This Article seeks to demonstrate these issues and introduce solutions to solve this dilemma.
