Abstract EN

This study constitutes one of the most important studies concerning judicial that and Administrative Law, if not the most important of all other laws.

It represents the role of the French State Council in creating and innovating the judicial solution in law suits and claims that are free from legislative support to apply on any dispute.

This study includes to demonstrate and reveal this role from two sides : the first side represents the establishing of law rules, and the second side represents in developing these rules.

For that purpose, it was designated an independent subject research for every side.

We tried through these researches to display the most important distinguished marks in these two important roles according to a systematic study aiming at revealing the nature of these two roles, and their relations together, and the method the council selects.

We ended this study in a final conclusion concluded the most important conclusions and recommendations.
