The DNA as a recent tool in forensic sciences is one of decisive innovations for proving the crime and discovering the criminal.

Never theless, its use gave rise to some legal problems concerning the collect of samples, the qualification of laboratories habilitated to perform this kind of test and the conditions required by the judge in criminal cases.

I gave a special attention to the Qatari Law on DNA to examine its regulation on the issue and the conditions of its admission by the judge in criminal cases.

The flaws and defects of the Qatari Law are underlined in order to improve its mechanism.

However, this study is a comparative one inasmuch as the French and the American Law are concerned.

I examined the American Law carefully in order to comprehend the accurate conditions laid down by the Federal and the local laws on the subject.

I made a review of the Ame rican judicial decisions to analyze them with a view to know the conditions required to accept this test and to comprehend how the American Law re conciles the rights of the defendant with the protection of society interests.
