Since the Corona pandemic affected the world at the end of 2019, and only changed the face of the world, that pandemic affected all aspects of life, and affected countries large and small, advanced and backward, democratic or dictatorial.

Rather, its impact did not extend only to countries, but to peoples and ordinary individuals, and affected their lives, livelihoods, rights and freedoms.

Within the framework of its constitutional duty to preserve the health of its citizens, many countries have taken precautionary measures and measures to counter the spread of this pandemic, and these measures have resulted in restricting public rights and freedoms such as freedom of movement, freedom of assembly, freedom to practice religious rites, and many other freedoms.

Many concerned with human rights and international organizations feared that governments would use this pandemic to impose more restrictions on public freedoms and undermine human rights.

Therefore, this research was an attempt to explain the general constitutional controls and principles that the authorities must adhere to when carrying out their constitutional duties to preserve the public health of their citizens, and to ensure that this exceptional circumstance is not exploited in adding more restrictions on public freedoms, while presenting modern applications of constitutional justice in Some developed countries (Germany - France - USA) to indicate the constitutionality of precautionary measures and measures by the authorities to confront the pandemic.
