The issue of custody is one of the topics that preoccupied social circles, because of its impact on the interests of the child, as we find that the Iraqi legislator, although he referred to the conditions that must be met in the incubator according to Article (57) of the Personal Status Law, but did not deprive the mother of custody, but that The draft personal status law has indicated depriving the mother of custody in the event of her marriage, and this matter put forward by the legislator is not considered a real treatment of the issue, as there must be a treatment that serves the interests of the custodian and the custodian at the same time.
