Abstract EN

In this research, we aim to demonstrate the appropriate punishment in cases that affect the security and stability of the state، through considering jurisprudential adaptation، and unveiling the opinion of Islamic jurisprudence on this type of crimes.

The paper starts with a topic that introduces the concept of Discretionary Penalty (Ta’zeer) and the difference between forms of the death sentence penalty، by examining the Islamic scholars’ statements regarding this issue.

Second، it defines state security crimes, their types، and how serious they are.

Third, the study explores the jurisprudential adaptation of state security crimes، in addition to stating the opinion of Islamic jurisprudence about this type of political cases based on the statements of jurists on the issue of imposing death sentence as Discretionary Penalty.
