The subject of international responsibility like other subject in the international arena, is not immune to change and adaptation to the requirements of actors and current events, and since the environmental issues has increased, it was inevitable to seek to develop rules related to international liability in a way that suits the specificity of the environmental damage, which is what the international law commission sough through its project seeking to codify the “international responsibility for harmful results resulting from activities not prohibited by international law” in two parts : 2001 and 2006.

states may not conclude a treaty based on this project to avoid everything that may limit their sovereignty, but this will not negate its importance, as it may enter the field of international law as a part of international custom.
