In the face of the economic transformations that took place at the end of the twentieth century and at the beginning of the twenty-first century, many legal concepts at the level of their principles, organization, and purposes were affected - including the theory of the defects of consent that were not spared from the contagion of the impact of fluctuations in economic conditions.

This has rendered the theory of defects of consent as stipulated in the Moroccan Code of Commitments and Contracts incapable of keeping pace with the winds of economic transformation and thus not conducive to achieving contractual security.
