however, criminal justice has failed to apply this principle effectively.

despite the legal guarantees stipulated in the statute of the international criminal court to prevent impunity for criminals as a court complementing the jurisdiction of national criminal courts, its effectiveness in combating international crimes, including war crimes, remained limited.

due to the multiple loopholes contained in this system, and the position of some countries hostile to its existence in the first place.

in the same field, the role of the national criminal courts remained weak in activating the principle of universal criminal jurisdiction to confront these crimes due to the multiplicity of its legal and political obstacles.
