This article aims at exposing the concept of the spouses’ family status and protecting it while highlighting the provisions of the Algerian legislature through the health act 18-11 by a legal regulation developed in accordance with the requirements of scientific developments, namely the technique of medically assisted procreation.

in order to safeguard the family's stability from being demolished, the family has been subjected to controls covering all issues of lineage, in addition to arranging a penalty for violating a regulation in the health act, and so this study came to look at IVF technique to solve many marital problems while clarifying the moral and social problems caused by it.
