The Algerian constitutional founder adopted the principle of oversight over the constitutionality of laws as an embodiment of the principle of the supremacy of the constitution in all constitutions that the country knew, except for the 1976 constitution.

Under the name of the Constitutional Council until the last constitutional amendment in 2020, when the latter was replaced by the Constitutional Court as a new oversight body aimed at protecting the constitution and strengthening the principle The separation of powers, the consolidation and preservation of constitutionally recognized rights and freedoms, and the task of settling disputes that may arise between the constitutional authorities, in addition to interpreting the constitution.

The constitutional founder stipulated the composition of the Constitutional Court, which retained some of the characteristics that characterized the composition of the Constitutional Council, and at the same time carried with it special features related to the conditions of membership in it.
