يعتبر مضمون العقد من أبرز الشروط المستخدمة لصحة العقد في القانون الفرنسي المعدل لموجب المرسوم 131 / 2016 فقد نصت المادة 1128 من التعديل على "يكون ضروريا لصحة العقد رضا الأطراف المتعاقدين و أهميتهم للتعاقد مضمون مشروع و أكيد" وقد قرنت المادة 1128 صراحة بين مضمون العقد المشروعية و المشروعية تعني عدم مخالفة العقد للنظام العام و الآداب العامة في شروطه و لا في أهدافه و يترتب على الإحلال بالمشروعية بطلان العقد بطلانا مطلقا
Abstract EN
The content of the contract is one of the most prominent conditions created for the validity of the contract in French law amended by decree 2016 / 131.
Article 1128 of the amendment stipulates that the validity of the contract shall be necessary to the consent of the contracting parties and their formally to contract and the legitimate and certain content.
Article 1128 has exsliecty associated the content of the contract with legality.
Legitimacy means that the contract does not violate public under and morals.
Neither in it's terms nor its objectives.
The violation of legality results in the validity of the contract completely invalidated.
