Arabic Abstract

تناولت الدراسة موضوعا على درجة من الأهمية يتمثل بالحماية الجزائية للآثار في الأردن من خلال الرجوع على القوانين الداخلية الناظمة لها مقارنة مع التشريعات الوطنية والاتفاقيات الدولية.

وتناولت الدراسة أهم الجرائم التي من الممكن أن تقع على الآثار من سرقة واتجار غير مشروع وإتلاف وتزوير والتنقيب المخالف لقواعد الترخيص والتهريب، وذلك من خلال بيان أركان الجريمة والتكييف القانوني لها وفقا لأحكام قانون الآثار الأردني رقم 21 لعام 1988 وتعديلاته، كما تطرقت الدراسة الى الاختصاص القضائي والصعيد الوطني و فق قانون أصول المحاكمات الجزائية والاختصاص القضائي على الصعيد الدولي، بالإضافة لبيان الحماية الدولية للآثار بموجب الاتفاقيات الدولية كاتفاقية لاهاي لعام 1954 واتفاقية توحيد القانون الخاص بالممتلكات الثقافية المسروقة واتفاقية اليونسكو لعام 1972 المتعلقة بحماية التراث العالمي الثقافي والطبيعي وقانون الآثار العربي الموحد.

وقد أوصت هذه الدراسة بضرورة تعديل نصوص المواد في التشريع الأردني فيما يتعلق بقانون الآثار بحيث تكون العقوبات أكثر ردعا لمن يعتدي على الآثار أو يشوهها أو يزيفها أو يسرقها أو بأي بصورة أخرى، كما أوصت بضرورة تعزيز التعاون بين الدول في الاتفاقيات الدولية في مجال الحماية الجزائية للأثار وذلك بأن يكون هناك تعاون بناء بين تلك الدول في عمليات الضبط والملاحقة والكشف عن الجريمة ومصادرة الآثار ووضع العقوبات الرادعة.

English Abstract

The study tackled a very important subject, which is the penal protection of antiquities in Jordan through returning to the internal rules, which organize this protection in comparison with national legislations and international treaties.

This study also tackled the most prominent crimes which may be committed against antiquities such as illicit trade, destruction, illegal excavation and smuggling through explaining the bases of every crime and the legal adaptation of the crime according to the Jordanian Law of Antiquities no.

21, 1988 and its modifications .

Moreover, it handled the national and international jurisdiction in addition to explaining the international protection of antiquities in accordance with international treaties like the Hague treaty 1954, the Unification of Private Law of Stolen Cultural Properties and Treaty of UNESCO1972 pertaining to the protection of the international cultural and natural heritage and the Unified Arab Law of Antiquities.

Taken as a whole, these treaties and agreements called all parties concerned to protect the cultural heritage being a property for all humankind in time of war or peace.

The study recommended the necessity of modifying the contents of articles in the Jordanian legislation pertaining to the Law of Antiquities in that the penalties become deterrent to those who transgress, deform, steal, and destroy antiquities.

It also recommended strengthening cooperation between countries and international conventions in the field of criminal protection of antiquities, by having constructive cooperation between those countries in the processes of seizure, prosecution, crime detection, confiscation of antiquities and setting deterrent penalties.
