Arabic Abstract

هدفت هذه الدراسة إلى البحث في أثر التعديلات الدستورية على عملية الإصلاح السياسي في الأردن، وذلك من خلال استعراض وتحليل التعديلات التي أجريت على قانون الانتخابات البرلمانية منذ عام 1989م الذي شهد عودة الحياة البرلمانية في الأردن، وحتى التعديلات الأخيرة التي أجريت عام 2022م بناء على مخرجات وتوصيات اللجنة الملكية لتحديث المنظومة السياسية، وذلك من حيث أثر هذه التعديلات على الانتخابات البرلمانية في الأردن.

وانطلقت الدراسة من تساؤل رئيسي؛ ما هو أثر التعديلات الدستورية على عملية الإصلاح السياسي وتحديدا على قانون الانتخابات البرلمانية من عام 1989م ولغاية عام 2022م، والفرض العام القائل؛ بأن هناك أثر للتعديلات الدستورية على عملية الإصلاح السياسي وتحديدا على قانون الانتخابات البرلمانية، ومحاولة الإجابة على التساؤل الرئيسي أعلاه وإثبات صحة الفرض العام من عدمه، حيث قسمت هذه الدراسة بناء على ذلك إلى ثلاثة فصول وما يتضمنها من مباحث ومطالب وفروع بالإضافة إلى خاتمة ونتائج وتوصيات.

وتوصلت الدراسة إلى إثبات صحة الفرضية التي انطلقت منها، بأن هناك أثرا واضحا للتعديلات الدستورية على عملية الإصلاح السياسي في الأردن، وتحديدا على قوانين الانتخابات النيابية منذ عام 1989م حتى عام 2022م، حيث عززت هذه التعديلات الدستورية من المشاركة السياسية الإيجابية لمختلف مكونات المجتمع الأردني وخصوصا المرأة والشباب.

وتوصي الدراسة بأهمية توسيع المشاركة الشعبية في الانتخابات البرلمانية من خلال السماح للأردنيين في الخارج بالمشاركة في الانتخابات من خلال السفارات الأردنية في الدول التي يقيمون بها، وذلك وفق المعايير الدولية للمشاركة في الانتخابات على سبيل المثال لا الحصر، وأيضا توصي الدراسة بضرورة أن تعزز الحكومات مسيرة الإصلاح السياسي في الأردن، من خلال تبني سياسات قابلة للتطبيق تعمل على زيادة المشاركة السياسية لمختلف أطياف المجتمع في الحياة السياسية.

English Abstract

This study aimed at researching the impact of constitutional amendments on the political reform process in Jordan through reviewing and analyzing the amendments made to the electoral law since 1989, which witnessed the return of parliamentary life in Jordan, until the latest amendments made in 2022 based on the outputs and recommendations of the royal commission on the modernization of the political system, in terms of their nature and the impact of these amendments on the public authorities in Jordan .

The study started from the main question of what is the impact of the constitutional amendments on the political reform process, specifically on the parliamentary elections law from 1989 to 2022, and the general assumption that there is an impact of the constitutional amendments on the political reform process, specifically on the electoral law, and an attempt to answer the above main question and prove the validity of the general assumption or not, as this study was divided accordingly into three chapters and its contained discussions and demands, in addition to conclusion, results and recommendations .

The study came to prove the validity of the hypothesis from which he proceeded that there is a clear impact of the constitutional amendments on the political reform process in Jordan, specifically on the laws of parliamentary elections since 1989 until 2022, as these constitutional amendments enhanced the positive political participation of various components of Jordanian society, especially women and youth.

The study recommends the importance of expanding popular participation in parliamentary elections by allowing Jordanians abroad to participate in elections through Jordanian embassies in the countries where they reside, in accordance with international standards for participation in elections, the study also recommends that governments should strengthen the political reform process in Jordan by adopting viable policies that increase the political participation of various segments of society in political life.
