Arabic Abstract

تعتبر قضية حماية النازحين خلال النزاعات المسلحة من أهم القضايا الإنسانية التي نالت جانبا هاما من قبل المنظمات والقانون الدولي لمحاولة إنقاذ أولئك النازحين من ويلات النزاعات المسلحة في العديد من دول العالم، لذا فقد سعت الدراسة الحالية لبيان الحماية الدولية للنازحين أثناء النزاعات المسلحة في القانون الدولي الإنساني، وتوصلت الدراسة إلى وجود قواعد حماية للنازحين في حالة النزاع المسلح في ضوء القانون الدولي الإنساني تمثلت بالمبادئ العامة الواردة في القانون الدولي الإنساني من خلال الحق في المساواة وعدم التمييز بين النازحين وحظر نزوح السكان بالقوة.

بالإضافة إلى وجود الأحكام الواردة في الاتفاقيات والمعاهدات الدولية التي حثت على ضرورة حماية الأفراد بشكل كلي من خلال أحكام اتفاقية جنيف الدولية لحماية المدنيين خلال فترة النزاع لسنة 1949م أحكام البروتوكولات الإضافية لسنة 1977، بالإضافة إلى أدوار المنظمات الدولية في حماية المدنيين خلال فترة النزاع متمثلة بأدوار الجمعية العامة للأمم المتحدة، ودور مجلس الأمن الذي يقوم على الحفاظ على الأمن والسلم الدوليين والتحقيق في النزاعات المسلحة بالطرق السلمية بين الأطراف المتنازعة أو باستخدام القوة كالعقوبات الاقتصادية أو تدخل قوات عسكرية دولية، ودور المحاكم الجنائية لمعاقبة الأشخاص التي تنتهك حقوق المدنيين والنازحين سواء الأطراف الدولية أو الأشخاص.

وأوصت الدراسة بضرورة تجريم ومعاقبة أي من الأفعال التي تحلق الخطر والأذى بالنازحين بشكل خاص.

English Abstract

The issue of protecting the displaced during armed conflicts is one of the most important humanitarian issues that have gained an important aspect by organizations and international law to try to save those displaced from the scourge of armed conflicts in many countries of the world, so the current study sought to demonstrate the international protection of the displaced during armed conflicts in international humanitarian law the study concluded that there are protective rules for the displaced in the event of armed conflict in the light of international humanitarian law represented by the general principles contained in international humanitarian law through the right to equality and non-discrimination between the displaced and the prohibition of population displacement by force.

in addition to the existence of provisions contained in international conventions and treaties that urged the need to fully protect individuals through the provisions of the international Geneva convention for the protection of civilians during the conflict period of 1949 and the provisions of the additional protocols of 1977, in addition to the roles of international organizations in protecting civilians during the conflict period represented by the roles of the association the general role of the united nations, the role of the un security council which is based on maintaining international peace and security and investigating armed conflicts by peaceful means between the conflicting parties or by using force such as economic sanctions or the intervention of international military forces, and the role of criminal courts to punish parties that violate the rights of civilians and displaced persons, whether international parties or persons.

the study recommended the need to criminalize and punish any of the acts that cause danger and harm to the displaced.
