Arabic Abstract

تعد أسماء النطاقات من أهم الأسس للشبكة المعلوماتية حيث أنها تتيح الدخول للمواقع الإلكترونية وتميز المواقع الإلكترونية بعضها عن بعض كما تميز مصدر المشروعات والمنتجات على شبكة الإنترنت، ومع ازدياد إنتشار الإنترنت حول العالم ومع سهولة الوصول إلى المواقع الإلكترونية وظهور العديد من العلاقات القانونية على شبكة الإنترنت ظهرت الحاجة لتحديد الطبيعة القانونية لهذه الأسماء حيث اختلفت الآراء الفقهية في تحديد الطبيعة القانونية لأسماء النطاقات، وبسبب حداثة أسماء النطاقات وقعت العديد من الإعتداءات عليها والتي ارتبطت ارتباطا وثيقا بحقوق الملكية الفكرية ومن هذه الإعتداءات القرصنة الإلكترونية التي نشأت نتيجة لإعتماد مبدأ الأسبقية في التسجيل لتسجيل أسماء النطاقات كما ظهرت العديد من صور الإعتداءات التي لم تكن معروفة قبل وجود أسماء النطاقات.

واستنادا إلى المنهج الوصفي والمنهج التحليلي فقد توصلنا في هذه الدراسة وفي ظل غياب التشريعات المنظمة لأسماء النطاقات على الصعيد الوطني والإقليمي إلى أن الحماية المدنية لأسماء النطاقات الوطنية في وقتنا الراهن تتم من خلال دعوى المنافسة غير المشروعة ودعوى التعويض المبنية على أساس المسؤولية التقصيرية، كما توصلنا الى أن حماية أسماء النطاقات العليا العامة (الدولية) تتم من خلال قواعد السياسة الموحدة والتي تنظم أحكامها منظمة (الآيكان) والتي تعد الجهة الوحيد المسؤولة عن أسماء النطاقات على المستوى الدولي.

كما أوصينا في الدراسة العديد من التوصيات، ومن أهمها ضرورة تنظيم قوانين خاصة تتعلق بأسماء النطاقات من خلال إخضاعها لتشريعات الملكية الفكرية أو من خلال تنظيمها في أحكام قانون ساري المفعول مثل قانون المعاملات الإلكترونية بصفته القانون الأقرب صلة بطبيعة أسماء النطاقات.

English Abstract

Domain names are one of the most important foundations for the information network, as they allow access to websites, distinguish websites from each other, and distinguish the source of projects and products on the Internet.

Because of increasing spread of the Internet around the world, easily access to websites, and the emergence of many legal relationships on the Internet, the need to determine the legal nature of these names emerged.

Jurisprudential opinions differed in determining the legal nature of domain names.

As a result of the novelty of the domain names, many attacks occurred against them.

These attacks are closely related to intellectual property rights, and one of these attacks is electronic piracy, which arose as a result of the adoption of the principle of precedence in registration for the domain names, and many images of attacks that were not known before the existence of domain names appeared.

In this study which basically depends on the descriptive analytical approach during the absence of legislation regulating domain names at the national and regional levels, at the present time, we conclude that civil protection for national domain names time is carried out through the unfair competition claim and the compensation claim based on tort liability.

We also concluded that the protection of generic (international) domain names is carried out through the rules of the unified policy, whose provisions are regulated by the ICANN organization, which is the only body responsible for domain names at the international level.

In this study, we also made several recommendations, the most important of which is the need to regulate special laws related to domain names by subjecting them to intellectual property legislation or by regulating them in the provisions of a valid law such as the Electronic Transactions act as the closest law to the nature of domain names.
