Arabic Abstract

تتناول هذه الدراسة ممارسات وأعمال السلطة التشريعية في العراق ومدى تطابقها مع القواعد والمبادئ التي نص عليها الدستور العراقي لعام 2005.

وحاولت هذه الدراسة بيان نقاط الضعف في النظام البرلماني العراقي، من خلال المقارنة بالنظام الأردني الذي يطبق الديموقراطية النيابية، وايضا المملكة المتحدة التي تعتبر مهد البرلمانات في العالم.

تهدف هذه الدراسة إلى التطرق على واقع مجلس النواب العراقي، من خلال ممارسته لصلاحياته الدستورية من تشريع ورقابة، وايضا مدى تطبيق مبدأ الفصل بين السلطات والإلتزام به بإعتباره اهم مبدأ دستوري يقوم عليه النظام النيابي.

وتم تحليل النصوص الدستورية التي نصت على المراحل التي يمر بها تشريع القوانين في العراق، وايضا ادوات الرقابة التي نص عليها الدستور العراقي، والنظام الداخلي لمجلس النواب، مقارنة بالدول محل الدراسة.

وكان من الضروري ايضا الحديث عن الدستور العراقي لعام 2005 والاختلال الذي يتضمنه في توزيع الصلاحيات بين السلطات.

من خلال تغليب كفة السلطة التشريعية عن باقي السلطات، الأمر الذي أدى إلى إساءة استعمال السلطة والابتعاد عن تحقيق الغاية الأسمى والأهم (المصلحة العامة).

وكانت اهم نتيجة توصل إليها الباحث، هي بإن نتيجة منح الصلاحيات الكبيرة للسلطة التشريعية في العراق أدت بدورها إلى إساءة استعمال السلطة والانحراف عن غايتها الأساسية التي وجد المجلس من أجلها.

وأهم توصية يقدمها الباحث، ضرورة إجراء تعديلات على النصوص الدستورية في المادة (61) من الدستور العراقي وخاصة فيما يتعلق بالصلاحيات الكبيرة التي يتمتع بها النواب لضمان عدم إساءة استعمالها، وذلك من خلال التوزيع العادل للصلاحيات بين السلطات.

English Abstract

This thesis deals with the practices and actions of the legislative authority in Iraq and their compatibility with the rules and principles stipulated in the Iraqi constitution of 2005.

through comparison with the Jordanian system that applies representative democracy, and also the United Kingdom, the cradle of parliaments in the world.

this study aims to address the reality of the Iraqi council of representatives, through its exercise of its constitutional powers of legislation and oversight, as well as the extent to which the principle of separation of powers is applied and adhered to, as it is the most important constitutional principle on which the representative system is based.

the constitutional texts that stipulate the stages of legislation in Iraq, as well as the oversight tools stipulated in the Iraqi constitution, and the internal system of the house of representatives, were analyzed, compared to the countries under study.

it was also necessary to talk about the Iraqi constitution of 2005 and the imbalance it contains in the distribution of powers between the authorities.

by giving precedence to the legislative authority over the rest of the authorities, which led to the abuse of power and a move away from achieving the supreme and most important goal (the public interest).

the most important result reached by the researcher, is that the result of granting great powers to the legislative authority in Iraq, in turn, led to the abuse of power and deviation from its basic purpose for which the council was found.

the most important recommendation made by the researcher is the necessity of making amendments to the constitutional texts in article (61) of the Iraqi constitution, especially with regard to the great powers enjoyed by representatives to ensure that they are not abused, through a fair distribution of powers between the authorities.
