Arabic Abstract

هدفت هذه الدراسة إلى التعريف بماهية التحكيم والاستثمار الأجنبي، كما هدفت إلى إبراز أثر التحكيم في تشجيع الاستثمار الأجنبي في الأردن، وبرزت أهمية الدراسة لما يعتبر عند المستثمر من أهمية في تسوية منازعات الاستثمار؛ لاختلاف المركز القانوني لأطراف هذه المنازعات، ورغبة المستثمر الأجنبي إلى اللجوء لجهة محايدة، مما جعل من نظام التحكيم وسيلة لتسوية هذه المنازعات، وضمانا لحقوق المستثمر ووجوده، وقد ارتكزت مشكلة الدراسة في أن عقود الاستثمار تبرم بين طرفين، حيث ينتمي كل منهما لنظام قانوني مختلف عن الآخر، مما يثير مشكلة أساسية في هذه العقود، وهي كيفية التوفيق بين ما يسعى إليه الأردن لتحقيقه، وبين ما يسعى إليه المستثمر الأجنبي من تنمية أمواله واستثماراته، وقد استخدم الباحث المنهج الاستقرائي لاستقراء نصوص القوانين المرتبطة بموضوع الدراسة، والمنهج التحليلي في تحليل المفاهيم الخاصة بموضوع الدراسة، كما استخدم الباحث المنهج المقارن؛ وذلك لمقارنة بعض مواد القانون الخاص بالدراسة مع القوانين المصرية ذات الصلة.

وتوصلت الدراسة إلى عدة نتائج أهمها: مرونة إدارة إجراءات التحكيم أثناء سير العملية التحكيمية سواء من قبل أطراف الخصومة التحكيمية أو من قبل هيئة التحكيم، كما أظهرت أن المشرع الأردني لم يلزم المحكم بشروط معينة وقيود لاختيار مكان التحكيم عند اختلاف أطراف الخصومة التحكيمية على تحديده، بل الزمه بمراعاة ظروف الدعوى التحكيمية وظروف أطراف الخصومة التحكيمية.

في ضوء النتائج أوصى الباحث بعدة توصيات أهمها: تشريع نص مادة قانونية في قانون التحكيم الأردني رقم (16) لسنة 2018 حول طلب أعادة المحاكمة المذكورة بنص المادة 213.

English Abstract

This study aimed to define what arbitration and foreign investment is, and also aimed to highlight the impact of arbitration in encouraging foreign investment in Jordan.

Due to the different legal status of the parties to these disputes, and the desire of the foreign investor to resort to a neutral party, which made the arbitration system a means to settle these disputes, and to guarantee the rights and existence of the investor.

The other, which raises a fundamental problem in these contracts, which is how to reconcile what Jordan seeks to achieve, and what the foreign investor seeks to develop his money and investments, The researcher used the inductive approach to extrapolate the texts of laws related to the subject of the study, and the analytical approach in analyzing the concepts of the subject of the study.

The researcher also used the comparative approach.

This is to compare some articles of the study law with the relevant Egyptian laws.

The study reached several results, the most important of which are: the flexibility of managing arbitration procedures during the course of the arbitration process, whether by the parties to the arbitration dispute or by the arbitral tribunal.

Require him to take into account the circumstances of the arbitration case and the circumstances of the parties to the arbitration dispute.

Through the results, the researcher recommended several recommendations, the most important of which are: Enacting the text of a legal article in the Jordanian Arbitration Law number (16) of 2018 regarding the request for a retrial mentioned in the text of Article 213.
