Arabic Abstract

منذ القرن التاسع عشر وإلى الآن لا يزال العالم منشغلا بقضية المياه المشتركة، برغم أن حدة هذه المشكلة قد أصبحت من الماضي في أوربا وأمريكا، وبقيت آثارها في أفريقيا وفي بعض دول شرق آسيا والشرق الأوسط، فلابد من تظافر الجهود في سبيل تطبيق المعاهدات والبروتوكولات المتعلقة بالمجاري المائية الدولية المستخدمة لأغراض غير ملاحية على الاحواض المائية المشتركة وما يتضمنها من حقوق والتزامات لكل الدول المتشاطئة، بالإضافة الى حل النزاعات التي تنشب نتيجة لهذا الاستخدامات وفقا لأحكام القانون الدولي المتمثلة في المعاهدات سواء الشارعة منها أو العقدية والتي من أهمها اتفاقية استخدام المجاري المائية الدولية لأغراض غير ملاحية عام 1997.

فهنالك انهار دولية كثيرة مشتركة في العالم مثل نهر النيل ونهر الفرات وهما اهم نهرين في الشرق الأوسط والمنطقة العربية بالإضافة الى نهر الراين والدانوب في أوروبا ونهر السنغال ونهر الكونغو في افريقيا.

English Abstract

Since the nineteenth century until now, the world is still preoccupied with the issue of shared water.

Although the severity of this problem has become a thing of the past in Europe and America, and its effects remain in Africa and in some countries in east Asia and the middle east, efforts must be combined in order to implement treaties and protocols related to international watercourses used for non-navigational purposes on the shared water basins, and the rights and obligations they contain for all riparian states.in addition to resolving disputes that arise as a result of these uses in accordance with the provisions of international law represented in treaties, whether legal or contractual, the most important of which is the 1997 convention on the use of international watercourses for non-navigational purposes.

There are many international rivers in common in the world, such as the Nile and the Euphrates, which are the two most important rivers in the middle east and the Arab region, in addition to the Rhine and Danube in Europe, the Senegal river and the Congo River in Africa.
