Arabic Abstract

هدفت الدراسة إلى بيان تأثير التدابير و القرارات غير معهودة التي اتخذتها الحكومات عقب تفشي جائحة كورونا على العقد الإداري و بالتالي اختلال التوازن المالي للعقد نتيجة هذه التدابير للوقاية من الفايروس، و للحفاظ على الصحة البشرية و السلامة العامة فقد تم أغلاق معظم المرافق الحيوية في البلاد و فرض حظر التجوال و هذا ما أدى بدوره إلى تعطل و شل حركة سير المرافق العامة بانتظام و اضطراد و بالتالي جعلت المتعاقدين مع الإدارة العامة يتعرضون لخسارات فادحة إضافة إلى جعل تنفيذ التزاماتهم العقدية و أن لم تكن مستحيلة جاءت مرهقة لهم، لذا استدعى الوضع البحث في تكييف الآثار التي خلفتها الجائحة و الطبيعة القانونية لها و التعرض للقرارات التي اتخذتها الجهات المختصة للوقاية من الفايروس و التي تركت آثارا سلبية على التوازن المالي للعقد الإداري.

و بينت هذه الدراسة آثار جائحة كورونا على العقد الإداري في حدود نظريتي الظروف الطارئة و القوة القاهرة، و تقدم هذه الرسالة دراسة تحليلية مقارنة عن طريق إسقاط القواعد العامة للظروف الطارئة و القوة القاهرة على الجائحة و تسلط الضوء على التشريعات ذات الصلة بالعقود الإدارية بما تضمنته من أحكام تخص الظروف الطارئة و القوة القاهرة و تناول الشروط القانونية لها و إبراز الآثار المترتبة عليها، و دور القاضي في معالجة الاختلال الذي احدثته الجائحة على التوازن المالي للعقد الإداري و موقف التشريعات ذات الصلة بموضوع الدراسة مع التعرض لبعض التطبيقات العملية و التطرق لبعض قرارات المحاكم ذات الصلة.

و قد خلصت الرسالة إلى أن آثار و تداعيات الجائحة على العقد الإداري تتفاوت فيما إذا كانت ظرف طارئ أم قوة قاهرة، و أن هذه الآثار تقاس وفقا لمعايير موضوعية تتعلق بالناحية الاقتصادية للعقد الإداري الذي اختل توازنه من جراء الجائحة، إضافة إلى أنه يجب أن تعامل كل علاقة عقدية على حدة وفق ظروف إبرام كل عقد، و بالتالي فالقاضي سلطة تقديرية في تكييف آثار و تداعيات الجائحة على العقد الإداري فيما إذا كانت ظرف طارئ ليحك يرفع الإرهاق على المتعاقد المتضرر بعد لجوء المتعاقد إلى القضاء و مطالبته بذلت ما يمكننا بيانه من توصيات : توسيع اختصاصات القضاء الإداري في كل من العراق و الأردن بحيث، تشمل العقود الإدارية لانه الاقدر على معرفة مكونات العقد الإداري وطبيعة أهدافه، و إضافة نصوص تشريعية تشكل الإطار العام للجوائح و كيفية معالجة آثارها الاقتصادية، و تضمين العقود الإدارية بند الجوائح و الأوبئة ليسهل الأمر لأطراف النزاع في معرفة الآثار القانونية التي تترتب عليها.

English Abstract

The unfamiliar decisions and measures have been conducted by governments after the widespread of corona virus has affected the administrative contracts as well as disrupting its financial balance as a result of these preventive measures which had been taken to preserve human health and public safety.

Many basic utilities has been closed and curfew has imposed as well which in its turn led to paralyzing the constant and steady workflow of basic utilities.

Consequently, this has exposed the contractors with the public administration to massive losses in addition to turning the implementation of their contractual obligations into stressing if it’s not impossible ones.

Therefore, the situation called for examining the adaption of the effects of the pandemic, the legal nature, and exposure to the decisions taken by the concerned authorities to prevent the virus, which left negative effects on the financial balance of the administrative contract.

The subject of this thesis is to determine the effects of the Corona pandemic on the administrative contract within the limits of the theories of emergency conditions and force majeure.

Moreover, it present a comparative analytical study by projecting the general rules of emergency conditions and force majeure on the pandemic, shedding a light on the provisions of the civil law in the Iraqi, Jordanian and Egyptian legislation, including provisions related to emergency circumstances and force majeure its legal conditions, its main implications, the role of the judge in addressing the financial imbalance of the administrative contract caused by the pandemic and the of the legislation stance related to the subject of the study.

As well as exploring some practical applications and addressing some relevant court decisions.

The study concluded that the effects and implications of the pandemic on the administrative contract vary, whether it is an emergency circumstance or a force majeure, and that these effects are measured according to objective criteria related to the economic aspect of the administrative contract whose balance has been disrupted by the pandemic.

Moreover, each contractual relationship must be treated separately according to the circumstances of the conclusion of each contract, and therefore the judge has the discretion to adjust the effects and implications of the pandemic on the administrative contract whether it is an emergency circumstance and thus eliminating the pressure on the aggrieved contractor after his legal remedy and claiming.

In case of force majeure, the contract is legally annulled.

The study recommended the unification of jurisprudence and the appointment of an independent judicial body to settle disputes arising from pandemics and epidemics in order to guarantee the rights of the parties to the conflict, adding up legislative provisions that constitute the general framework for pandemics and how to address their economic effects and appending pandemics and epidemics legal clause to administrative contracts so the parties to the conflict will easily know the legal effects.
