Arabic Abstract

تم تسليط الضوء في هذه الدراسة على جريمة التحرش الإلكتروني، حيث اتبعت هذه الدراسة المنهج الوصفي التحليلي، و المنهج المقارن مع التشريع المصري و السعودي، حيث تطرقت الدراسة إلى بيان ماهية التحرش الإلكتروني و من ثم بيان أركان جريمة التحرش الإلكتروني، و التفريق بينها و بين الجرائم الأخرى المشابهة لها، و ذلك باتباع المنهج الوصفي التحليلي المقارن، و في النهاية بينت الدراسة المسؤولية الجزائية التي تترتب على ارتكاب هذه الجريمة في التشريع الأردني و التشريعات المقارنة، حيث توصلت الدراسة إلى أن المشرع الأردني لم يعالج جريمة التحرش الإلكتروني، على خلاف المشرع المصري و السعودي اللذين رتبا حماية جزائية لتلك الجريمة، حيث تطور مفهوم التحرش بالتطور التقني الراهن فأصبح يقع من خلال الوسائل الإلكترونية، فلم يعد يقتصر التحرش على الشكل التقليدي، فتحول من الواقع المادي إلى الواقع الافتراضي، و إن خلق التشريع الأردني من نص يجزم التحرش الإلكتروني يعد نقصا تشريعيا يجب تداركه، حيث أوصت الدراسة بضرورة تجريمها و التصدي لها، و أوصت المشرع الأردني بتضمين قانون الجرائم الإلكترونية جريمة بالإضافة إلى مجموعة من التوصيات و النتائج ذكرتها الباحثة في نهاية الدراسة.

English Abstract

In this study, the crime of electronic harassment was highlighted, as this study followed the descriptive analytical approach, and the comparative approach with the Egyptian and Saudi legislation, where the study dealt with the statement of the nature of electronic harassment through its concept and forms, and the effects that result from it in addition to its causes, and then a statement of the elements of the crime of electronic harassment, and differentiate between it and other similar crimes, In the end, the study showed the criminal responsibility that results from committing this crime in Jordanian legislation and comparative legislation, where the study found that the Jordanian legislator did not address the crime of electronic harassment, unlike the Egyptian and Saudi legislators, who arranged penal protection for that crime, where the concept of harassment evolved with the current technical development and became located through electronic means Harassment is no longer limited to the traditional form, so it has shifted from physical reality to virtual reality, and the absence of a text in Jordanian legislation criminalizing electronic harassment is a legislative deficiency that must be corrected, especially with the increase in cases of harassment with the spread of excessive use of social networking sites..Where the study recommended the need to criminalize and address it, and recommended the Jordanian legislator to include in the Cybercrime Law the crime of electronic harassment as one of the electronic crimes in addition to a set of recommendations and results mentioned by the researcher at the end of the study.
