Arabic Abstract

لجريمة الإتجار بالبشر آثارا سلبية على المستويات السياسية و الاجتماعية و الاقتصادية للمجتمعات لأنها تعد أحد أنشطة الجريمة المنظمة، لذلك أتت هذه الدراسة لتسليط الضوء على نقاط الضعف في القانون الدولي و التشريعات الوطنية في التصدي لهذه الجريمة، و هذا جعل المجتمع الدولي امام تحد كبير و مهم أوجب عليه اتخاذ تدابير رادعة تكفل المواجهة الفعالة لهذه الجريمة.

و عالجت هذه الدراسة أيضا الوضع القانوني لهذه الجريمة في التشريعين الأردني و العراقي و بيان الإجراءات التي اتخذاها على الصعيد الوطني و مدى مواءمتها لأحكام الاتفاقيات الدولية.

توصلت هذه الدراسة أن المشرعان الأردني و العراقي لم يشترطان استخدام وسائل لارتكاب جريمة الإتجار بالبشر.

حيث ضيقا نطاق هذه الجريمة، و أخضعا أحكام الاشتراك الجرمي فيها إلى القواعد العامة في تشريعاتهم الجزائية و اعتمدا توافر قصد الاستغلال الذي يعتبر ركنا خاصا بهذه الجريمة وهذا يثير صعوبة في تكييف هذه الجريمة.

و توصلت أيضا إلى أن سياسة المشرع الأردني تعتبر من السياسات الرائدة في مكافحة الاتجار بالبشر من خلال تبنيه نمطا وقائيا و أسلوبا جديدا في تجريم طائفة من الأفعال التي من شأنها أن تسهل ارتكاب هذه الجريمة.

و كذلك توصلت إلى ضرورة تفعيل دور منظمات المجتمع المدني و اللجان الوطنية المتخصصة بمكافحة الإتجار بالبشر و التنسيق مع الجهات ذات العلاقة و التعاون مع المؤسسات الأمنية و الأكاديمية و الدينية و وسائل الاعلام للتوعية بمخاطر هذه الجريمة و سبل الوقاية منها و إعداد تقارير سنوية و إصدارها على المستوى الإقليمي و الدولي و وضع الخطط و البرامج اللازمة لمكافحتها.

English Abstract

The crime of human trafficking has negative effects on the political, social and economic levels of societies because it is one of the activities of the organized crime.

Therefore, this study came to shed light on the weaknesses in international law and national legislation in addressing this crime.

This made the international community before a great and important challenge, which obliged it to take deterrent measures to ensure an effective response to this crime.

In addition, the study dealt with the legal status of this crime in the Jordanian and Iraqi legislations and also showed the measures they have taken at the national level and their compatibility with the provisions of international conventions.

This study found that the Jordanian and Iraqi legislators did not require the use of means to commit the crime of human trafficking.

Where the scope of this crime was narrowed, and they subjected the provisions of criminal participation in it to the general rules in their penal legislation and adopted the availability of the intent of exploitation, which is considered a special element of this crime, and this raises the difficulty in adapting this crime.

It also concluded that the Jordanian legislator's policy is considered one of the pioneering policies in combating human trafficking by adopting a preventive pattern and a new method in criminalizing a range of acts that would facilitate the perpetration of this crime.

It also concluded the necessity of activating the role of civil society organizations and national committees specialized in combating human trafficking, coordinating with the relevant authorities and cooperating with security, academic and religious institutions and the media to raise awareness of the dangers of this crime and ways to prevent it, preparing annual reports and issuing them at the regional and international levels, and setting the necessary plans and programs to combat it.
