Arabic Abstract

إن الموظف العام و أثناء توليه مهام الوظيفة العامة قد تنسب إليه من الإدارة التي يعمل بها بعض المخالفات الإدارية التي تستوجب التأديب، و إن النظام التأديبي لا يكون بشكل عشوائي أو اعتباطي إنما بموجب نصوص قانونية خاصة ضمنها المشرع في قوانين الوظيفة العامة والخدمة المدنية و حدد إجراءاتها بشكل دقيق، و لم يغفل المشرع عن إحاطة الموظف المنسوب له مخالفة تأديبية ما بضمانات جوهرية تكفل حقه في إثبات براءته، و يشكل التحقيق الإداري أهم و أسمى هذه الضمانات، كما أن المشرع قسم الضمانات التي قررها للموظف العام على ثلاث مراحل، منها ما يسبق قرار الإحالة على التحقيق الإداري، و منها ضمانات آنية أثناء التحقيق الإداري، و ضمانات لاحقة للتحقيق الإداري، و بذلك تظهر الغاية التشريعية في تقرير و تشريع هذه الضمانات في ناحيتين، الأولى : تتمثل بضمان سير المرافق العامة بالشكل الذي لا تنعكس فيه إجراءات التحقيق على الوضع النفسي و الاجتماعي و المالي للعامل بالشكل الذي يخفض من مستواه في تقديم الخدمة العامة، و تتمثل الناحية الثانية : بمنع التعسف الإداري تجاه الموظف و إعطاءه فرصة بالدفاع عن نفسه لإثبات براءته من جهة ومنع امتهان كرامته فيما إذا كان مذنبا عن طريق تحديد الإجراءات التي تتبعها الإدارة في إصدار قرار العقوبة التأديبية بشكل مسبق من المشرع.

English Abstract

The public employee, while assuming the tasks of the public office, may be attributed to him from the administration in which he works some administrative violations that require discipline, and that the disciplinary system is not random or arbitrary according to special legal texts, including the legislator, the laws of public service and civil service And he specified its procedures in a precise manner, and the legislator did not neglect to inform the employee who is accused of a disciplinary offense of fundamental guarantees that guarantee his right to prove his innocence.

The decision to refer to the administrative investigation is preceded, including immediate guarantees during the administrative investigation, and guarantees subsequent to the administrative investigation.

Thus, the legislative purpose appears in deciding and legislating these guarantees in two aspects.

The first is to ensure the functioning of public utilities in a manner in which investigation procedures do not reflect on the psychological and social situation The second aspect is to prevent administrative abuse towards the employee and give him an opportunity to defend himself to prove his innocence on the one hand and prevent his dignity from being insulted if he is guilty by specifying the procedures followed by the administration in issuing a disciplinary penalty decision Prior to the legislator, and on the foregoing, the researcher presented by careful and comparative analysis between each of the public service systems in Jordan, Iraq and Egypt these guarantees in an effort to develop them as much as possible and protect the public employee and the public utility alike.
