Arabic Abstract

أصبحت جرائم الفساد الإداري والمالي إحدى الآفات التي لم تسلم منها المجتمعات والدول بغض النظر عن طبيعتها، ولكن بدرجات متفاوتة من دولة لأخرى، فغالبا ما تشيع هذه الجرائم في الدول النامية بدرجة أكبر نتيجة عوامل عدة لا مجال لذكرها، ويعد العراق واحدا من أكثر الدول التي عانت من جرائم الفساد المالي والإداري خلال السنوات الأخيرة الماضية، حيث استغل بعض المتنفذين في السلطة تراجع الوضع الأمني وغياب القانون نتيجة التغير السياسي بعد 2003 للعبث بأمن ومقدرات الشعب، مما أدى إلى ضياع ثروة هائلة تقدر بمئات المليارات من الدولارات تم تهريبها إلى خارج البلد منذ 2003 حتى الآن، دون أي إجراءات جدية من الجهات الرقابية في الدولة، لذا تهدف هذه الدراسة إلى تسليط الضوء على السياسة الجزائية لاسترداد الأموال المهربة في كل من العراق والأردن، بالمقارنة مع اتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003.

English Abstract

Administrative and financial corruption crimes have become one of the scourges that societies and countries have suffered from, regardless of their nature, but in varying degrees from one country to another.

These crimes are more common in developing countries, for reasons too numerous to mention here.

Iraq is one of the countries that suffered from crimes of financial and administrative corruption during the past years, as some people in power took advantage of the deteriorating security situation and the weakness of law, after the political change of 2003 to manipulate the people's security and public funds, which led to the loss of vast wealth estimated at hundreds of billions of dollars, smuggled out of the country from 2003 until now, without any serious measures from the regulatory authorities in the country, so this research aims to shed light on the penal policy to recover smuggled money in both Iraq and Jordan, in comparison with the United Nations Convention against Corruption for the year 2003.
