Arabic Abstract

تناولت الدراسة بالعرض والتأصيل موضوع الأحكام القانونية لعمل الأحداث في التشريع الأردني (دراسة مقارنة)، والدافع من هذه الدراسة هو الكشف عن الحماية القانونية للأحداث والنظر في مدى كفاية القواعد القانونية المتعلقة لعمالة الأحداث، وكذلك في بيان من هم أطراف العقد في عقود العمل المبرمة مع الأحداث وبيان ما إذا كانت عقود العمل المبرمة مع الاحداث تعد اتجارا بالبشر من خلال تسليط الضوء على الاتفاقيات الدولية والعربية في هذا المجال، تظهر مشكلة الدراسة في مدى كفاية القواعد القانونية المتعلقة بعمل الأحداث، وعرض الأثار التي تترتب على عقد العمل وعرض موضوع الرقابة على الأحداث وتشغيلهم ومدى تطبيق القانون الأردني للاتفاقيات الدولية المصادق عليها، تم استخدام المنهج الوصفي التحليلي والمنهج المقارن، وقد توصلت الدراسة الى عدد من النتائج كان من أبرزها: أن التشريعات والاتفاقيات الدولية اهتمت بعمالة الاحداث وذلك من خلال توفير الحماية القانونية لهم، كما أن المشرع الأردني كان موفقا في العديد من القضايا التي تتصل بعمل الاحداث ومن ذلك تحديد ساعات العمل وكذلك الفحص الطبي قبل العمل وأيضا منح إجازة أسبوعية ورسمية للعامل الحدث بما ينسجم مع الاتفاقيات العربية والدولية المنظمة لعمل الاحداث، أن المشرع لم يأت بالنص على عدد من القضايا التي تتعلق بعمالة الاحداث ومن ذلك الفحص الطبي أثناء العمل ومنح الإجازة السنوية وفي ضوء توصي الدراسة بضرورة قيام المشرع الأردني بالنص على ضرورة فحص الحدث العامل دوريا أثناء العمل للتأكد من سلامته.

English Abstract

The study dealt with presentation and rooting the issue of legal provisions for the work of juveniles in Jordanian legislation (a comparative study).

And to clarify whether the work contracts concluded with juveniles constitute human trafficking by shedding light on the international and Arab conventions in this field, the problem of the study appears in the adequacy of the legal rules related to the work of juveniles, and the presentation of the effects of the work contract and the presentation of the issue of control over juveniles and their employment and the extent The application of the Jordanian law to the ratified international conventions, The descriptive analytical approach and the comparative approach were used, and the study reached a number of results, the most prominent of which were: that international legislation and conventions concerned the employment of juveniles by providing legal protection for them, and the Jordanian legislator was successful in many Among the issues related to the work of juveniles, including determining working hours, as well as a medical examination before work, as well as granting an official weekly leave to the The juvenile factor in line with the Arab and international conventions regulating the work of juveniles, that the legislator did not come up with a text on a number of issues related to the employment of juveniles, including the medical examination during work and the granting of annual leave, and in light of the study recommends the need for the Jordanian legislator to stipulate the need to examine the juvenile worker periodically during Work to ensure its safety.
