Arabic Abstract

هدفت الدراسة إلى بيان الآثار القانونية المترتبة على الدفع بعدم دستورية القوانين، والبحث في مدى حجيته وفاعلية ونجاعة الدفع بعدم الدستورية في تحقيق غاياته المرجوة منه، مع التطرق إلى أهم التشريعات والأحكام القانونية ذات العلاقة بموضوع الدراسة، إذ اتبع الباحث المنهج الوصفي والتحليلي، وذلك من خلال استعراض لنصوص القوانين والأحكام القضائية العراقية والأردنية ذات العلاقة والتي هي ذات صلة مباشرة في الدراسة، وتحليلها والبحث فيها، كما استخدم الباحث المنهج المقارن من خلال المقارنة بين التشريع العراقي والأردني، والتي تتحدد في نصوص الدستور الأردني والدستور العراقي والتشريعات المقارنة.

وتوصلت الدراسة إلى عدد من النتائج أبرزها أن أثر الحكم بعدم الدستورية يدور في النظام الدستوري المقارن الذي تبنى أنظمة الرقابة ما بعد القضاء بين ثلاثة أشكال: الامتناع عن تطبيق النص المحكوم بأنه غير دستوري، أو إلغاء هذا النص، أو إلغاء قوة تنفيذه، ويوصي الباحث بضرورة تنظيم كل ما يتعلق بالحكم الصادر من المحكمة الاتحادية العليا بشأن عدم دستورية النصوص التشريعية سواء من حيث حجية هذه الأحكام والأثر القانوني المترتب عليها والنطاق الزمني لتنفيذها وكيفية هذا التنفيذ في مواجهة السلطات العامة والكافة، وذلك بموجب نصوص صريحة في الدستور، كما يوصي المشرع الأردني بتوضيح نصوص قانون المحكمة الدستورية بما يتماشى مع التعديل الدستوري لسنة 2022 للمادة (60 / 2) من الدستور الأردني.

English Abstract

The aim of the research is to clarify the legal implications of advocating the unconstitutionality of laws, and to research the extent of its authority, effectiveness and efficiency in achieving its desired goals, while addressing the most important legislation and legal provisions related to the subject of the study, as the researcher followed the descriptive and analytical approach, through A review of the texts of relevant Iraqi and Jordanian laws and judicial rulings that are directly related to research, analysis and research, which are specified in the texts of the Jordanian constitution, the Iraqi constitution and comparative legislation.

The researcher also used the comparative approach by comparing the Iraqi and Jordanian legislation, which is determined in the texts of the Jordanian constitution In line with the 2022 constitutional amendment of Article (60/2) of the Jordanian Constitution, the Iraqi constitution and comparative legislation.

The research reached a number of results, most notably that the effect of the ruling of unconstitutionality revolves around the comparative constitutional systems that adopt the post-judicial control system between three forms: refraining from applying the text judged to be unconstitutional, or canceling this text, or canceling the force of its implementation, and the researcher recommends the necessity of Regulating everything related to the ruling issued by the Federal Supreme Court regarding the unconstitutionality of legislative texts, both in terms of the authority of these provisions, the legal effect on them, the time scope of their implementation, and the method of this implementation in the face of public and all authorities, in accordance with explicit provisions in the constitution.

The Jordanian legislator also recommends clarifying the provisions of the Constitutional Court Law in line with the 2022 constitutional amendment of Article (60/2) of the Jordanian Constitution.
