Eviction from marital housing is a confiscation of the right to housing that is legitimately and legally guaranteed and an infringement of human dignity, and this right becomes more important whenever the party deprived of it is a woman.

And if marital life is supposed to be a moral life in its natural form that revolves around love and not justice, then the social and cultural transformations and value changes that Moroccan society is witnessing, like other societies, may tend human nature to practice violence against the closest people, and the nature of this violence may reach an extent Deprivation of housing and the expulsion of one spouse by the other from this housing.

This work sheds light on the nature of the Legitim protection of women's right to marital housing, and the protective mechanisms approved by the Moroccan legislator to protect this right, through a comparative analytical study between the Islamic jurisprudential perspective and the Moroccan legislative perspective.
