While the French laïcité principle has long been defined as the principle of state neutrality, in recent decades it has been increasingly used against certain expressions of private religiosity in public.

However, while secularism as a political discourse now extends well beyond the purely institutional conception of neutrality, legal doctrine has proven to be resistant, at least to some extent, to this more expansive conception.

In this article, it will be discussed how these controversies and ambiguities regarding the scope and application of the French laïcité principle crystallized in a final controversial issue concerning the dismissal of a veiled worker, in a private nursery.

Here it will be noted that while the case of Baby Loup's private custody asserts that secularism as such did not formally extend to the private sphere, it also illustrates important limits in the flexibility of the traditional distinction between the public and private spheres.
