The human right to physical integrity is considered one of the fundamental rights enshrined in the Algerian constitution, and it has become an urgent need for comprehensive legal protection in light of the spread of serious infectious and epidemic diseases.

This study presented the position of the Algerian law regarding an important legal issue arising from the transmission of these diseases, as we discussed the criminal responsibility of the person who knows or should know that he is a carrier of the epidemic disease, yet he does not adhere to the duty of care towards his family and society as a whole, as well as The extent of commitment of health practitioners treating a person carrying the disease to the duty to warn their patients towards others, in light of the New general criminalization brought in by the new Penal Code No.
