Arabic Abstract

تناول هذا البحث الأحاديث الضعيفة والموضوعة في فقه البيوع والمعاملات المالية والتي استدل بها فقهاء المذاهب الأربعة على الأحكام الفقهية على تفاوت بينهم قلة وكثرة.

وفيه مقدمة تمهيدية في بيان مكانة السنة في التشريع الإسلامي، والموازنة بين منهج الفقهاء والمحدثين في قبول الأحاديث وردها، مع ذكر نماذج من النظرة النقدية للأحاديث عند كل من الفقهاء والمحدثين، وحكم العمل بالحديث الضعيف في الأحكام.

وقد تم استخراج الأحاديث الضعيفة والموضوعة في البيوع والمعاملات من الكتب الفقهية الآتية: بداية المجتهد ونهاية المقتصد لابن رشد، والمجموع شرح المهذب للنووي مع تكملتيه، والمغني لابن قدامة، والهداية في شرح بداية المبتدي للمرغيناني، حيث تم اعتماد كتاب من كل مذهب فقهى من المذاهب الأربعة.

وتمت دراسة الأحاديث الضعيفة والموضوعة التي احتج بها الفقهاء في المسائل الفقهية دراسة حديثية نقدية والحكم عليها، وبيان أثر استشهاد الفقهاء أو بعضهم بها في المسائل والأفرع الفقهية في باب البيوع والمعاملات المالية.

وقد اشتملت الدراسة على فصلين الفصل الأول في الأحاديث الضعيفة المتعلقة بالبيوع، في باب الخيارات، وبيع السلم، والربا، وفي البيوع المنهي عنها بسبب أهلية العاقد، وبسبب المعقود عليه، وبسبب وصف ضار، وبسبب شرط مخالف لمقتضى العقد، وفي البيوع المنهي عنها بسب نهي شرعي.

وأما الفصل الثاني: ففي الأحاديث الضعيفة المتعلقة بالمعاملات، في باب المشاركات والضمانات والاستحفاظات والعقود والتوثيقات والتقييدات والتبرعات، وأحكام الأراضي والاستصلاحات.

وتضمنت الخاتمة أهم النتائج والتوصيات.

English Abstract

This research deals with the weak and fabricated hadiths in the jurisprudence of sales and financial transactions, which were inferred by the jurists of the four schools of jurisprudence.

The researcher begins with an introduction that clarified the status of the Sunnah in Islamic legislation, and sought to balance the approach of jurists and hadith scholars in accepting and refuting hadiths, with examples of the critical view of hadiths for both jurists and hadith scholars, and the ruling on considering the weak hadith in rulings.

Weak and fabricated hadiths on sales and transactions have been extracted from the following jurisprudential books: Bidayat AlMujtahid, Nihayat Al-Muqtadat by Ibn Rushd, Al-Majmoo’ Sharh AlMuhadhab by Al-Nawawi with its complements, Al-Mughni by Ibn Qudamah, and Al-Hidaya in Sharh Bidayat Al-Mubtadi by AlMarghinani, where a book was adopted from each of the four schools of jurisprudence.

The weak and fabricated hadiths that were addressed by the jurists in jurisprudential issues were studied using a critical Hadith study and a ruling on them was made, and the researcher clarified the impact of the citation by the jurists or some of them on the issues and branches of jurisprudence in the chapter of sales and financial transactions.

The study included two chapters; the first chapter looked into the weak hadiths related to sales, in the chapter on options, in the sale of peace, and in usury, and in sales that are prohibited because of the capacity of the contracting party, because of the contracted party, because of a harmful description, and because of a condition contrary to the contract, and in sales that are prohibited due to a legal prohibition.

The second chapter dealt with the weak hadiths related to transactions, in the chapter on partnerships, guarantees and reservations, contracts and authentications, restrictions, donations, and provisions for lands and reclamations.

The conclusion included the most important results and recommendations.
